Welcome to Cade. These Terms of Service ("Terms") govern your access to and use of the Cade mobile application (the "App") operated by Cade ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Acceptance of Terms
By accessing or using the App, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the App on behalf of another person (such as a family member), you represent that you have the authority to accept these Terms on their behalf.
2. Description of Service
Cade is a health information application that allows you to scan product barcodes, analyze ingredients, check for potential drug interactions, review nutritional information, and generate AI-powered health reports. The App provides general health and wellness information for educational and informational purposes only.
3. Medical Disclaimer
THE APP DOES NOT PROVIDE MEDICAL ADVICE.
The information provided by Cade, including but not limited to drug interaction alerts, nutritional analysis, health condition warnings, and AI-generated reports, is for informational purposes only and is not intended as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions regarding a medical condition. Never disregard professional medical advice or delay seeking it because of information provided by the App.
In case of a medical emergency, call your doctor or emergency services (911 in the United States) immediately. Cade is not designed for use in emergency situations.
4. User Accounts
You may use certain features of the App without creating an account. If you choose to create an account, you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
5. Subscriptions and Payments
Cade offers both free and premium subscription tiers. Premium features are available through monthly, annual, or lifetime subscription plans. Subscriptions are processed through the Apple App Store or Google Play Store, and are subject to their respective terms and refund policies.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
- You can manage or cancel your subscription through your device's App Store or Play Store settings
- Refunds are handled by Apple or Google in accordance with their policies
- Prices are subject to change with reasonable notice; existing subscribers will be notified before any price increase takes effect
- Lifetime subscriptions provide access for the lifetime of the App's availability
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws
- Attempt to reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's servers or networks
- Use automated means (bots, scrapers) to access the App
- Misrepresent your identity or provide false information
- Use the App to provide medical advice to others or represent yourself as a healthcare professional
7. Intellectual Property
The App and its original content, features, and functionality are owned by Cade and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.
8. User-Generated Content
You retain ownership of any content you provide to the App (such as health profile data, scan history, and notes). By using the App, you grant us a limited license to process this content solely for the purpose of providing the App's services to you. We do not claim ownership of your health data.
9. Data Accuracy
While we strive to provide accurate information, we rely on third-party databases (including the National Library of Medicine, FDA, and Edamam) that may contain errors or omissions. Product formulations change, new research emerges, and databases are updated periodically. We do not guarantee the completeness, accuracy, or timeliness of any information provided through the App.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CADE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR HEALTH OUTCOMES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless Cade and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another party.
12. Termination
We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App will immediately cease. You may delete your account and data at any time through the Settings screen.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
